These Terms of Use govern access to and use of the HOLZ — Private Capital Partners website (the “Site”). By accessing or using the Site, you acknowledge that you have read, understood and agreed to these Terms of Use.
If you do not agree to these Terms, you should not use the Site.
1. ABOUT HOLZ
HOLZ — Private Capital Partners (“HOLZ”, “we”, “us” or “our”) provides independent investment architecture and related professional services to private clients.
Services are offered exclusively to Qualified Clients, in accordance with the Advisory Law.
References to “Qualified Clients” are to clients who meet the applicable definition under Israeli law. Nothing on this Site constitutes a representation that any person qualifies or is eligible to receive services from HOLZ.
2. PURPOSE OF THE SITE
The Site provides general information about HOLZ, its professional approach and its areas of activity.
The content is provided for general informational and introductory purposes only. It is not intended to constitute, and should not be interpreted as:
- Investment advice, investment marketing or portfolio management;
- A personal recommendation;
- Legal, tax, accounting or financial advice;
- An offer, invitation or solicitation to purchase, sell or subscribe for any security, fund, financial instrument or investment;
- A representation that any investment, institution or structure is appropriate for a particular person; or
- A substitute for an individual assessment of a client’s objectives, circumstances, liquidity needs and risk parameters.
No decision should be made solely in reliance on information appearing on the Site.
3. NO CLIENT RELATIONSHIP
Accessing the Site, reviewing its content or contacting HOLZ does not create a client, advisory, fiduciary, agency or other professional relationship.
A professional relationship will arise only if expressly agreed in writing and subject to all applicable eligibility, identification, regulatory, contractual and onboarding requirements.
HOLZ is not a bank, custodian or deposit-taking institution. Client assets remain held directly with the relevant bank, custodian, investment vehicle or other selected institution, under the client’s ownership and control.
4. QUALIFIED CLIENTS AND JURISDICTION
The Site and the services described on it are intended exclusively for Qualified Clients and for persons in jurisdictions where access to such information and services is lawful.
The availability of the Site in a particular jurisdiction does not constitute an offer to provide services in that jurisdiction.
Users are responsible for determining whether their access to and use of the Site complies with the laws and regulations applicable to them.
HOLZ may decline to provide information or services to any person where doing so may be unlawful, inappropriate or inconsistent with its professional or regulatory obligations.
5. INVESTMENT RISKS
Investments involve risk. The value of investments may rise or fall, and investors may lose some or all of the capital invested.
Private-market and alternative investments may involve additional risks, including limited liquidity, long holding periods, valuation uncertainty, leverage, concentration, limited transparency, complex documentation and restrictions on transfer or redemption.
Past performance is not indicative of future results. Any references to market conditions, investment structures or potential outcomes are illustrative only and do not constitute a promise, forecast or guarantee.
6. ACCURACY AND AVAILABILITY OF INFORMATION
HOLZ makes reasonable efforts to present information accurately and clearly. However, information on the Site may be incomplete, become outdated or contain errors.
HOLZ does not warrant that the Site or any of its content is accurate, complete, current, suitable, uninterrupted or free from technical errors.
HOLZ is under no obligation to update information on the Site immediately following changes in markets, law, regulation, business circumstances or third-party information.
HOLZ may modify, suspend or discontinue any part of the Site at any time without prior notice.
7. THIRD-PARTY INFORMATION AND LINKS
The Site may include information obtained from third parties or links to websites, institutions, managers, custodians or other external sources.
Such information and links are provided for convenience only. HOLZ does not control third-party websites and does not warrant their accuracy, availability, security, content or practices.
The inclusion of a reference or link does not constitute an endorsement, recommendation or representation regarding the relevant third party, its services or any investment associated with it.
Use of third-party websites is subject to their own terms and privacy policies.
8. INTELLECTUAL PROPERTY
Unless otherwise stated, all content on the Site—including text, branding, design, layout, graphics, photographs and other materials—is owned by or licensed to HOLZ and is protected by applicable intellectual-property laws.
Users may view and download limited portions of the Site solely for personal and non-commercial use.
No content may be copied, reproduced, modified, distributed, republished, transmitted, displayed, commercially exploited or incorporated into another work without prior written permission from HOLZ.
“HOLZ” and “HOLZ — Private Capital Partners”, together with their associated wordmarks and visual identity, may not be used without prior written permission.
9. PERMITTED USE
Users must not:
- Use the Site for any unlawful, fraudulent or misleading purpose;
- Attempt to gain unauthorised access to the Site or its supporting systems;
- Interfere with the Site’s operation or security;
- Introduce malicious code, viruses or other harmful material;
- Use automated tools to scrape, extract or reproduce Site content without permission;
- Impersonate another person or misrepresent their identity or eligibility; or
- Use the Site or its content in a manner that infringes the rights of HOLZ or any third party.
10. ELECTRONIC COMMUNICATIONS
Internet and email communications may not be secure, confidential, uninterrupted or free from error.
Users should not send highly sensitive financial, identification or account information through unsecured email.
HOLZ does not accept responsibility for loss or damage arising from transmission failures, unauthorised interception, malware, incorrect contact details or other risks inherent in electronic communications.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, HOLZ and anyone acting on its behalf will not be liable for any direct or indirect loss, damage, expense or claim arising from:
- Access to, use of or inability to use the Site;
- Reliance on information contained on the Site;
- Errors, omissions or delays in updating content;
- Third-party information, services or websites;
- Technical interruptions, security incidents or unauthorised access; or
- Any decision or action taken on the basis of Site content.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
12. PRIVACY
Use of the Site is also subject to the HOLZ Privacy Policy, which explains how information may be collected, used and protected.
13. CHANGES TO THESE TERMS
HOLZ may update these Terms of Use from time to time.
The updated version will be published on the Site and will take effect from the date stated at the top of the page. Continued use of the Site following an update constitutes acceptance of the revised Terms.
14. GOVERNING LAW AND JURISDICTION
These Terms of Use and any dispute arising from the Site or its use will be governed by the laws of the State of Israel.
The competent courts in Tel Aviv–Jaffa, Israel, will have exclusive jurisdiction, subject to any mandatory provision of applicable law.
